1. Agreement to Terms 

By browsing our website, creating an account, or placing an order with Cornbread Creek (the “Store”), you agree to these Terms of Service and all policies referenced herein (Privacy Policy, Refund Policy, Shipping Policy). If you do not agree, please do not use our Store.

2. Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to place an order. By ordering, you represent that you meet this requirement.

3. Account Registration

You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Product Information & Availability

We do our best to display accurate colors, sizes, descriptions, and pricing. However, we do not warrant that product descriptions or other content are 100% accurate, complete, or error-free. We may correct errors (including pricing errors) at any time, even after an order is placed, and may cancel or refund affected orders.

5. Pricing & Payment

All prices are shown in USD and include applicable taxes unless stated otherwise. We reserve the right to change prices without notice. Payment must be received before we accept or ship any order.

  5.1  Sales Tax.  For customers outside our home state of Texas, we generally are not required to collect sales tax due to state nexus and threshold rules.  We do pay sales tax on items shipped to those states from our suppliers as necessary.

6. Order Acceptance & Cancellation

Placing an order does not guarantee acceptance. We may refuse or cancel any order at any time for reasons including (but not limited to): suspected fraud, unauthorized payment, product unavailability, or pricing errors. If we cancel after payment, we will issue a full refund. There is a brief delay between the time you place your order and when we begin to process your order. If you contact us during this period, we may be able to cancel your order for a full refund. After your order has started processing, our refund policy will apply.

7. Shipping & Delivery

Shipping times are estimates only. We are not responsible for delays caused by carriers, customs, weather, holidays, or other events outside our control. Risk of loss and title pass to you when the package is handed to the shipping carrier.

8. Returns, Refunds & Exchanges

Please see our separate Refund Policy for full details. All return requests must be made within 30 days of the purchase date and comply with that policy.

9. Intellectual Property

All content on this website (text, photos, logos, designs, graphics) is owned by us or our licensors. You may not copy, reproduce, modify, distribute, or create derivative works without our written permission.

10. Prohibited Conduct

You agree not to:

• Use the site for any unlawful purpose, fraudulent, or abusive purpose

• Place fake orders or attempt payment fraud

• Interfere with the site or servers

• Copy or scrape content for commercial use

We may terminate or suspend your access immediately if you violate these rules.

11. Limitation of Liability

To the fullest extent permitted by law:

• Our total liability for any claim is limited to the amount you paid for the product(s) in question.

• We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits), even if advised of the possibility.

• We are not liable for delays or failure due to causes beyond our reasonable control (force majeure).

12. Disclaimer of Warranties

Products are provided “as is” and “as available” without warranties of any kind, except as stated in writing. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to defend and indemnify Cornbread Creek and its owners, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your use of the Store.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Texas, United States of America, without regard to conflict of law principles. Any dispute must be brought in the state or federal courts located in Montgomery County, Texas.

15. Changes to These Terms

We may update these Terms at any time. The latest version is posted here. Your continued use of the Store after changes constitutes acceptance of the new terms.
